Sturtevant man gets 38 years for fatal shooting

RACINE, Wis. (AP) — A Sturtevant man has been sentenced to 38 years in prison for fatally shooting a man in a darkened pole barn last year.

Forty-seven-year-old Scott Mertins Sr. will serve another 13 years on extended supervision.

Mertins was sentenced Monday in Racine County for firing the shot that killed 54-year-old Robert Greene, formerly of Mount Pleasant. Greene and his girlfriend were in town attending a funeral when Greene was shot in Yorkville on Aug. 26, 2012.

The Journal Times reports Mertins said at his sentencing he didn’t mean to harm anyone.

Greene was asleep in the pole barn with his girlfriend when he got up to investigate a noise and was shot.

The defense maintained Mertins had been drinking when he decided to retrieve some belongings stored in the barn.
