MADISON, Wis. (AP) – A Wisconsin appeals court has ordered a new trial for a Beloit man who was sentenced to life in prison for fatally stabbing his ex-girlfriend.
Donyil Anderson was convicted in the 2008 slaying of Stacey Hosey. He also received a 20-year sentence for the attempted slaying of her boyfriend, Brandon Beavers-Jackson.
Anderson’s appeal argued that his mental state was influenced by his taking Strattera, a drug used to treat attention deficit hyperactivity disorder, and instructions to the jury didn’t distinguish between voluntarily taking a lawfully prescribed medication and the use of illegal drugs.
The appeals court agreed and sent the case back Thursday for a new trial.
Anderson’s attorney, William Schmaal, said he had not time to fully understand the decision and could not yet comment.
