State gets 8K in settlement from off-label claims

Wisconsin’s Medicaid program will recoup more than $8,000 in a nationwide settlement resulting from a whisteblower action filed in federal court.

The payout is part of $15 million in civil damages ISTA Pharmaceuticals Inc. has agreed to pay the states and federal government. The settlement resolves allegations that ISTA marketed its drug Xibrom for uses that were not approved by the Food and Drug Administration, and paid doctors to write Xibrom prescriptions between January 2006 and March 2011.

Wisconsin received $8,202.54 as the state share of $20,814.43 attributable to Wisconsin Medicaid.

This settlement is based on whistleblower actions filed in U.S. District Court for the Western District of New York under state and federal false claims statutes.
