State won’t appeal order on Capitol access

MADISON, Wis. (AP) — Gov. Scott Walker’s administration says it will not challenge a federal judge’s order forcing changes to the policy governing who has access to the state Capitol.

U.S. District Judge William Conley on Monday said that portions of the Capitol access policy were unconstitutional, and ruled that no group with fewer than 20 people can be required to get a permit. Under the policy, permits were required for most activities in the Capitol involving four or more people.

Mike Huebsch, Walker’s Department of Administration secretary, said Wednesday the judge’s order won’t be appealed.

The judge’s order did not invalidate the permitting process itself, which Huebsch says remains in full effect for the Capitol and grounds.
