Milwaukee on Monday earned a partial victory in a 2010 lawsuit filed against it by Jon Ferraro, a businessman who hoped to open night clubs featuring exotic dancing in the city.
The city denied requests made by Six Star Holdings LLC and Ferol LLC, both owned by Ferraro and both based in Menomonee Falls, and did not take action on a 2011 request by Six Star. Ferraro sued the city and claimed, among other things, the city’s ordinance governing tavern amusement was unconstitutional.
U.S. District Judge Lynn Adelman, in Monday’s order, decided the ordinance was not unconstitutional. However, Adelman also decided the city was liable to Six Star for damages related to its failure to take action on the 2011 request.
A scheduling conference will be held in April to discuss a timeline to address the lawsuit’s other points.
