MADISON, Wis. (AP) — The state Supreme Court has ordered a hearing for a Milwaukee day care owner who lost her license under a law designed to crack down on child care fraud.

The Department of Children and Families revoked Angelia Jamerson’s license in 2010. The agency in part cited a law that prohibits anyone convicted of defrauding public assistance programs from holding a child care license. Jamerson had been convicted nearly 20 years earlier of failing to report income that would make her ineligible for public assistance.

An administrative law judge concluded a hearing would be moot. The Supreme Court ruled Thursday it’s unclear whether Jamerson engaged in deliberate fraud.

A spokeswoman for the state Justice Department, which represented DCF, referred questions to that agency. DCF officials didn’t immediately return a message.
