Panel: Time to move on discipline for Prosser

MADISON, Wis. (AP) – The Wisconsin Judicial Commission has asked the state Supreme Court to move ahead on discipline proceedings against Justice David Prosser.

The commission filed a request with the court Friday asking it to appoint a panel of appellate judges to consider the commission’s misconduct complaint against Prosser.

The conservative-leaning justice is accused of wrapping his hands around Justice Ann Walsh Bradley’s throat during an argument last year in front of four other justices.

Prosser argues the review panel’s formation requires a formal Supreme Court order. He’s been working to make sure the court never issues that order, asking his fellow justices to recuse themselves from the matter because they witnessed the altercation.

The commission’s attorney, Franklyn Gimbel, countered Friday that state law mandates the Supreme Court initiate the panel’s formation.
