Wis. Supreme Court accepts 14 new cases

The state Supreme Court in December voted to accept 14 new cases, according to the Wisconsin Court System website.

The cases are as follows:

2010AP2801-CR: State v. Frey, which “examines whether there are  limitations on the way in which a dismissed charge can be used by a sentencing court and whether a trial court must provide prior notice to a defendant that it might consider dismissed charges in fashioning a sentence.”

2010AP2762: Wis. Industrial Energy Group v. PSC, which “involves a dispute over the Wisconsin Public Service Commission’s approval process, and whether a certificate of public convenience and necessity was needed for a Wisconsin public utility to construct a wind electric generating facility in Minnesota.”

2010AP2514-CR: State v. Ziegler, which “examines whether there was sufficient evidence to convict the defendant of interference with child custody.”

2010AP557-CR: State v. Miller, which “examines whether anonymous tips provided reasonable suspicion for police officers to initiate” a vehicle stop.

2010AP505-CR: State v. Martin, which “examines several issues related to Miranda warnings.”

2010AP1785: Aldrich v. LIRC (Labor and Industry Review Commission), which considers “whether a Wisconsin Fair Employment Act claim was untimely under Wisconsin law.”

2011AP1112: Milwaukee Journal v. City of Milwaukee, which “examines whether previous Supreme Court decisions authorized government authorities to charge for the staff time required to separate and redact confidential information from public records.”

2011AP329-FT: Waldvogel Trucking v. LIRC is an unemployment compensation case in which the court will examine “whether an employee who uses illegal drugs, thus making him ineligible for employment, may receive unemployment benefits.”

2010AP1192-CR: State v. Smith (Roshawn) is a criminal case involving two petitions for review.

2010AP258: Weborg v. Jenny, which examines two issues: “whether the trial court erred in allowing evidence of life insurance and social security payments following the death of William Weborg; and whether the trial court erred in modifying the standard jury instruction related to expert testimony.”

2010AP2705: DeBruin v. St. Patrick, which examines whether “religious organizations are immune from common law breach of contract lawsuits brought by ministerial employees.”

2010AP2900: Wis. Dolls v. Town of Dell Prairie in which the Supreme Court is asked to review three issues related to a dispute between the owners of Wisconsin Dolls, an adult-themed resort in the Wisconsin Dells, and the town of Dell Prairie and its town board, over a liquor license.

2010AP1599-CR: State v. Cain is a criminal case that “examines the circumstances under which a plea may be withdrawn.”

2010AP2533: Kroner v. Oneida Seven Generations Corp., which “involves an employment dispute and examines whether a civil suit was properly transferred from the circuit court to the Oneida Tribal Judicial System pursuant to Wis. Stat. § 801.54.”
