Appeals court upholds child porn conviction

Madison (AP) — A state appeals court has upheld a 2010 felony child porn conviction against a man whose girlfriend found a child porn video on the man’s laptop computer.

The 2nd District Court of Appeals ruled Tuesday against 24-year-old Kenneth Sobczak who argued his girlfriend did not have the authority to let police into his house and seize his laptop after she saw the video while he was at work.

Sobczak lived with his parents at the time and invited his girlfriend to stay with him for a weekend while his parents were away. He also allowed her to use his laptop while he was at work.

The appeals court says the girlfriend had the authority to let police in and to view the video.
