Breach of plea agreement

Mario E. Smith appeals from a judgment of conviction entered upon his guilty plea to leaving the scene of a motor vehicle accident resulting in death. He also appeals from an order denying his motion for postconviction relief. Smith contends that the State breached the parties’ plea bargain and that his trial lawyer was ineffective by failing to object. Because we conclude that the State did not breach the plea bargain, we affirm. This opinion will not be published.
