The deadline for attorneys to submit claims to recover from the BAR/BRI class settlement is fast approaching — May 30.
Anyone who took a BAR/BRI course to prepare for a bar exam from Aug. 1, 2006, to March 21 of this year is eligible to participate. More than $5 million is available, but exact payouts will vary from state to state, and from year to year.
The allegations of the class settlement are that, in violation of antitrust laws, BAR/BRI had an agreement with Kaplan not to participate in the market for LSAT preparation, while Kaplan agreed not to participate in the market for bar exam preparation.
According to a press release by the plaintiff class attorneys, payouts from the settlement will be decided as follows: after deducting attorney’s fees, costs and administration, in an amount to be approved by the court, the fund will be paid to class members who submitted a timely claim form. Awards will be calculated based on: (1) the amount paid by each class member; and (2) the number of timely claims submitted.
