Two years out of law school, Andrew N. DeClercq already has a win in front of the Wisconsin Supreme Court under his belt.

Working with Paul Norman at Boardman Law Firm, DeClercq experienced his first state Supreme Court victory in 2010 by helping with Volvo Trucks North America v. Wausau Truck Center, Inc.

The case involved Volvo’s efforts to terminate an agreement with the Wausau dealer, alleging a breach of that agreement. The big issue in the case came down to the definition of one small word —“cure.” Under state law, there was no clear indication of what it meant to cure a breach.

“The court agreed with our definition of cure, which was to have the breaching party be in substantial compliance with the contract,” DeClercq said. “The other side wanted a more onerous definition of cure.”

The young attorney was excited to be brought in to help despite the fact that a lot had happened before he joined the firm two years ago.

“It’s nice to know that the people you work with will trust you to work on something like that with them,” he said, “even if you were not there at the onset.”

United States v. Shipp, 214 U.S. 386 (1909).

What would you never wear?

Shoes on a beach.

What’s your favorite sports team?

Brazil (soccer).

What can you spend hours doing that’s not law-related?

Anything outside in the sun.

Can you drive a stick shift?

Yes.

What was your favorite toy as a child?

My stick horse.

Where and when are you happiest?

On my porch on a sunny weekend afternoon.

If you could be a superhero, who would you be?

The Silver Surfer.

Wii.

What famous person you would most like to have a drink with?

Clint Eastwood.

What is your favorite thing to do in Wisconsin?

Climbing at Devil’s Lake.

My chef’s knife.
