Listen to this article

Douglas E. Smith appeals from a judgment entered on a jury verdict convicting him of obstructing an officer, as an habitual criminal, and from the trial court’s order denying his motion for postconviction relief. He claims that the trial court did not adequately instruct the jury. He also claims that his trial lawyer did not give him effective assistance of counsel because the lawyer did not object to the trial court’s jury instructions. Smith asserts that he is entitled to an evidentiary hearing on his ineffective-assistance-of-counsel claim.
