Listen to this article

David J. Clark has appealed from an order entered in the trial court on Sept. 12, 2001. In the order, the trial court awarded Clark additional sentence credit in the amount of 202 days for the time he spent in custody between Aug. 28, 1990 and March 15, 1991. No challenge is made to this portion of the trial court’s order on appeal, and this portion is affirmed. However, Clark also requested additional credit as discussed more fully below.

We reverse the trial court’s order to the extent that it denies the additional credit requested by Clark, and remand the matter with directions to award Clark the additional credit.
