The State of Wisconsin appeals from an order declaring Wis. Stat. sec. 946.415 (1999-2000) unconstitutional and dismissing the complaint charging James G. Luck with one count of violating sec. 946.415(2). The State claims the trial court erred when it concluded that the statute was unconstitutional.

Because sec. 946.415 is constitutional, we reverse the order and remand this case for further proceedings.
