01-1121-CR State v. Newton

Listen to this article

Joseph Newton appeals a judgment convicting him of second-degree reckless endangerment and fleeing an officer, both as a habitual criminal. Newton also appeals the denial of his postconviction motions. Newton argues that his trial counsel was ineffective for failing to (1) request jury instructions on self-defense and defense of another and (2) object to the admission of other acts evidence. He also claims reversible error for the trial court’s admission of Newton’s prior convictions and for what he contends was improper judicial fact-finding.

We reject these arguments and affirm the judgment and order.
