Listen to this articleDarrell Shearer appeals an order revoking his operating privilege for refusing to submit to a chemical test of his blood alcohol concentration under Wis. Stat. sec. 343.305. He claims the trial court erred in concluding that the arresting officer had probable cause to arrest him for operating a motor vehicle while under the influence of an intoxicant (OMVWI) before requesting a blood test.
We disagree and affirm the revocation order.
