Richard Kubat appeals a judgment of conviction for misdemeanor battery. Kubat argues the trial court should have granted his motion for a directed verdict of acquittal following presentation of the State’s case and should not have instructed the jury on provocation. Kubat further asserts he was denied due process. We reject Kubat’s arguments and affirm. This opinion will not be published.
