WI Court of Appeals – District IV

Case Name: State of Wisconsin v. Kyle L. Parker

Case No.: 2017AP164-CR

Officials: Sherman, Blanchard, and Fitzpatrick, JJ.

Focus: Motion to Suppress Evidence

The State appeals a circuit court order granting Kyle Parker’s motion to suppress evidence obtained as a result of a search incident to arrest. The State argues that the circuit court erred when it determined that officers lacked probable cause to arrest Parker in the absence of physical evidence that Parker was committing a crime. Because we conclude that the totality of the circumstances was sufficient to establish probable cause that Parker was committing a crime, we reverse the circuit court’s order of suppression and remand for further proceedings.
