Referee: Milwaukee attorney’s license should be revoked

A referee is recommending that a Milwaukee attorney’s licensed be revoked over 74 charges of misconduct.

The recommendation stems from a complaint filed nearly a year ago originally charging Sergio Magaña with 27 counts of misconduct, including fabricating letters from the U.S. State Department and misleadingly telling clients that he done work on their cases. The Office of Lawyer regulation amended the complaint in December, adding 47 more alleged rule violations, including allegations that Magaña had failed to notify the agency and the Supreme Court Clerk that he had been convicted of a second drunken-driving offense.

Magaña failed to respond to the OLR’s complaint, and the OLR filed a motion in April calling for him to be found in default.

Magaña failed to attend a hearing on the motion held on May 23. The court-appointed referee, Jonathan Goodman, filed a report Monday finding Magaña in default and calling Magana’s behavior “egregious.” Goodman recommended that the Wisconsin Supreme Court revoke Magana’s license.

Goodman also recommended that Magaña pay the cost of the proceeding and $1,070 in restitution.

Magaña could choose to appeal the report. The Wisconsin Supreme Court will review Goodman’s recommendations and issue a final disciplinary order.
