Focus:  Court Error – Credibility – Admission of Evidence

Daniel Marquardt appeals from a judgment of conviction for sexual assault of a child under sixteen years of age and sexual exploitation of a child, and an order denying postconviction relief. Marquardt argues: (1) the circuit court erred in admitting hearsay testimony at the preliminary hearing; (2) the court denied his right of confrontation by limiting his cross-examination of the victim at trial; (3) the court erred in admitting into evidence a nude photo of the victim; (4) the state impermissibly vouched for the credibility of the victim in closing argument; and (5) he is entitled to a new trial in the interests of justice. We reject these arguments and affirm.
