Case Name: State of Wisconsin v. D.P.V.

The State appeals a trial court order dated June 14, 2016, that terminated the parental rights of D.P.V. and included the following statement: “This order is stayed for a period of six months (may extend an additional six months)[.]” The State argues that the trial court lacked authority to stay the order and seeks the immediate implementation of the order. D.P.V. crossappeals. He takes the position that this court “should affirm the circuit court’s order in all respects,” including the stay provision. In the alternative he argues that if the stay provision in the order is invalid, the entire order is invalid, and in that case the petition must be dismissed.
