A Mequon attorney who was disbarred in Illinois last year is agreeing that he should also be disciplined in Wisconsin.

According to an Office of Lawyer Regulation complaint filed Oct. 13, the Supreme Court of Illinois disbarred David Silberman last year for transferring more than $460,000 worth of real estate escrow money from his trust account into the operating account of a business he owned while he was an attorney for a title insurance company in Illinois.

The transfers were not for any use related to the escrow accounts. Silberman eventually transferred some of the money back. But more than $180,000 was not returned, according to the complaint.

The Office of Lawyer Regulation had asked the Wisconsin Supreme Court to impose reciprocal discipline on Silberman by revoking his license.

According to a stipulation between the OLR and Silberman, Silberman has agreed to all the facts laid out in the OLR’s complaint from last year and will not contest the discipline the OLR is seeking. As a result of the stipulation, no referee will be assigned to the case. The Wisconsin Supreme Court will instead be handing down a decision.
