Walker, other governors file brief against immigration order

Gov. Scott Walker and the governors of five other states have filed a brief in opposition to an executive order President Barack Obama issued allowing certain undocumented immigrants to legally remain in the United States.

More specifically, the brief filed Monday challenges the Deferred Action for Parents of Americans program as unconstitutional lawmaking that usurps Congress’ lawmaking authority. The program would let undocumented immigrants stay and work in the country if they have been in the United States since January 2010 and have children who are U.S. citizens or have a green card.

Twenty-six states, including Wisconsin, have filed a lawsuit against the order, which was issued by Obama in November 2014. The U.S. District Court for the Southern District granted a stay on the order and the 5th Circuit upheld that stay. The case is pending before the U.S. Supreme Court. A decision is expected in late June.
