Focus: Court Application of Statute – Ineffective Assistance of Counsel
This case comes to us on remand from the Wisconsin Supreme Court, which reversed our split decision granting Corey Kucharski a discretionary reversal. In its remand instructions the supreme court directed us to address Kucharski’s three remaining unaddressed issues: (1) whether the trial court misapplied the elements of WIS. STAT. § 971.15 (2013- 14) ; (2) whether the trial court’s conclusions regarding mental responsibility lacked support in the record; and (3) whether Kucharski was entitled to a new trial due to ineffective assistance of counsel.
