MADISON, Wis. (AP) — A Wisconsin Supreme Court justice has withdrawn his unusual request asking his colleagues to reconsider their decision not to hear an appeal of a felony conviction from a former aide to Gov. Scott Walker when he was Milwaukee County executive.

Justice Michael Gableman on Thursday filed his request in the case of Kelly Rindfleisch. On Tuesday, Gableman sent a letter to the attorneys withdrawing his motion.

Gableman writes in the letter that because Rindfleisch has a request pending before the U.S. Supreme Court to review the case, “that is a better course of action at this time.”

Rindfleisch was one of six people convicted in a so-called John Doe probe into Walker’s former aides and associates while he was the Milwaukee County executive.
