Motion for new homicide trial to be heard Sept. 4

La Crosse (AP) — The new attorney for a Minnesota man convicted of killing a father and son at a La Crosse photography store argues his previous lawyers failed him when jurors were selected during his trial.

Jeffrey Lepsch’s attorney, Steven Zaleski, says the previous lawyers failed to eliminate three jurors who reached a conclusion about his guilt before hearing the case. A prosecutor argues that all three jurors said they would base their verdict on evidence presented in the courtroom.

The La Crosse Tribune says a hearing on the matter will be held Sept. 4. If a circuit judge denies the motion for a new trial, Lepsch can take his case to an appeals court.
