Cedarburg attorney suspended again

A longtime Milwaukee-area attorney has been suspended for a year after representing clients while he was barred from practicing law.

Except for a four-month period in 2011, John Maynard has had his law license suspended since February 2010 for disciplinary and regulatory reasons. He last worked for Maynard, Schmitt & Associates LLP in Cedarburg.

In an opinion released Friday, the state Supreme Court said Maynard represented several clients while he was suspended as a result of a previous disciplinary case. He handled matters for several companies and used the name of his law firm in letters to the court, even though he was forbidden from doing so.

The opinion also states that Maynard served as an attorney for a company in Georgia, even though he was not licensed to practice there.

Maynard stipulated to the facts of the case brought by the Office of Lawyer Regulation and agreed that a one-year suspension was appropriate. The most recent suspension began Friday, though the court noted that Maynard also is behind on his State Bar dues and continuing legal education credits.

Maynard could not immediately be reached for comment.

Due to the length of his suspension, Maynard will have to petition the Supreme Court if he wants to be reinstated. The OLR complaint noted that Maynard tried to voluntarily surrender his license, but the request was denied because of the pending disciplinary case.

Maynard graduated from California Western School of Law in 1973 and was admitted to practice in Wisconsin the same year. He was disbarred from practicing in California in August for failing to comply while being suspended and not taking a professional responsibility exam.
