State high court dismisses redistricting case

The Wisconsin Supreme Court dismissed a Waukesha County case Monday that stemmed from a challenge to the state Republicans’ redistricting in 2011.

The court, minus Justice David Prosser, stated in an order that the issues at stake in the case were settled in June in a case in the Eastern District of Wisconsin. In that case, a group of Democrats and immigrant-rights group Voces de la Frontera sued, and a panel of federal judges last year ordered that two Assembly districts in Milwaukee be adjusted after ruling that the original configuration unfairly weakened Latinos’ voting rights.

Because the federal case was settled, parties in the case asked the state Supreme Court to dismiss the case. The court, in its order, agreed and explained that they will not take up the case.

“The respondents suggested that in light of the federal court decisions and the fact that no further recall or special elections are pending, this matter may have been rendered moot,” the order states.

That federal lawsuit gained momentum when the Republicans failed to turn over thousands of records when subpoenaed. However, the plaintiffs dropped their efforts after they found that thousands of files missing from state computers were not maliciously removed.
