Appeals court reverses homicide conviction

MADISON, Wis. (AP) — A Wisconsin appeals court has reversed a Milwaukee man’s homicide conviction.

A jury in 2011 found Raphfeal Lyfold Myrick guilty of first-degree intentional homicide in the shooting death of Marquise Harris.

Myrick argued on appeal that Milwaukee County Circuit Judge Rebecca Dallet improperly allowed prosecutors to read to the jury testimony he gave against a co-defendant as part of a plea deal.

The 1st District Court of Appeals ruled Wednesday that under the rules of evidence court statements made as part of a plea bargain are inadmissible in criminal proceedings against the person seeking the deal.

A spokeswoman for the state Justice Department, which handles felony appeals on behalf of local prosecutors, didn’t immediately return a message.
