State’s high court upholds child porn conviction

MADISON, Wis. (AP) – The Wisconsin Supreme Court says a woman legally consented to a police search that led to her boyfriend’s conviction on a child pornography charge.

Kenneth Sobczak pleaded no contest to possessing child pornography in 2010. According to court documents, his girlfriend, Kristina Podella, discovered a child porn video on his laptop while he was at work. She let a police officer into his Hartford house and allowed him to search the computer.

Sobczak argued Podella didn’t have the authority to invite the officer into the house or let him search the computer. But a majority of the justices ruled Thursday she could consent and the officer’s entry was legal. The justices noted the officer viewed only relevant files on the computer.

Sobczak’s attorney didn’t immediately return a call seeking comment.
