Damages in upside down flag case pending

GREEN BAY, Wis. (AP) — Damages in a case involving Crivitz police and free speech won’t be determined until October.

A federal judge ruled police erred when they removed an upside down American flag from a building Vito Congine was leasing. Congine was flying the flag upside down to protest the city’s decision not to grant him a liquor license for his business.

Police said they received complaints about the flag, so they took it down to prevent a disturbance. Judge William Griesbach ruled there was no clear and present danger.

Congine also claimed the officers violated his right against unreasonable seizure of his property. WLUK-TV says police argued that since Congine was not there when the flag was taken down, and he was only leasing the property, they didn’t violate his rights. Griesbach ruled that those factors didn’t make a difference.
