Municipalities — notice of claim

The Dillon Group, LLC sued the Village of Grafton for breach of contract. Dillon was involved in the development of a Tax Incremental Financing (TIF) district in downtown Grafton. According to Dillon, the Village did not meet its obligations under the development agreements. The circuit court held, and we agree, that Dillon did not serve the Village with a timely notice of claim under Wis. Stat. § 893.80 (2011-12)[1] and therefore Dillon’s suit is barred. Not recommended for publication in the official reports.
