Ruling puts Berlin lawsuit over mascot on hold

BERLIN, Wis. (AP) – The Berlin Area School District’s lawsuit over its high school mascot is on hold following a recent ruling involving a similar case.

In both Berlin and Mukwonago, complaints by residents to the state Department of Public Instruction resulted in orders to change their athletic team Indian nickname.

Parents in Mukwonago sued to overturn the decision and won in circuit court. That prompted some Berlin residents to hire the same lawyers and file a similar suit.

But recently, the state appeals court overturned the circuit court, ruling the parents didn’t have standing. DPI officials say the district now has until 2014 to drop the nickname.

WLUK-TV says Berlin will wait to see if the Wisconsin Supreme Court will hear an appeal in the Mukwonago case.
