Judge dismisses OWI case for former governor’s son

MADISON, Wis. (AP) – A Dane County judge has dismissed a drunken driving charge against the son of former Gov. Jim Doyle.

Judge Nicholas McNamara said police did not have probable cause to arrest Gus Doyle last December in Fitchburg. According to police reports, the younger Doyle was pulled over after an officer saw him weaving. Two officers say they detected the odor of alcohol. Doyle refused field sobriety tests and blood alcohol tests.

The case was handled by Green County special prosecutor Gary Luhman because the Dane County district attorney was appointed by Doyle’s father, the former governor. Luhman tells WKOW-TV he declined to ask McNamara to recuse himself because he too was appointed by Doyle. Luhman said he consulted with Fitchburg police in making that decision.

The judge did not immediately return a call seeking comment.
