Tobacco store sues state over roll-your-own cigarettes

MADISON, Wis. (AP) – A Rib Mountain tobacco store is suing the state over its attempt to pull the plug on roll-your-own cigarette machines.

The Department of Revenue has informed owners of the machines that they need cigarette manufacturing and distribution permits to operate. Customers who buy loose tobacco from the stores, then use the machines to roll their own cigarettes are saving on taxes.

Robert Petersen owns Rib Mountain Tobacco and Liquor. He’s filed a lawsuit in Dane County Circuit Court asking for a temporary injunction that allows the stores to continue operating the machines.

Petersen said store owners already pay a tax on the loose tobacco and turn the manufacturing process over to the customer.

The Wausau Daily Herald reports the Department of Revenue says roll-your-own retailers are expected to comply with state law.
