A Milwaukee man is suing two corporate titans for negligence.

Richard Regan filed a lawsuit Friday against Coca-Cola Enterprises Inc. and Wal-Mart Stores Inc. for unspecified damages tied to a 2009 accident that left the plaintiff with a rotator cuff tear in his left shoulder.

According to the complaint, Regan was shopping at the Walmart store at 4500 South 108th Street in Milwaukee on July 2, 2009, and tripped over a pallet of Coke products that were sticking out into an aisle.

Regan alleges negligence on the part of a Coke employee for creating a hazard by stacking the pallets in an unsafe manner, according to the complaint.

The plaintiff also alleged liability on the part of the store for failing to prevent the hazard.

Regan is seeking past and future medical expenses, pain and suffering and additional damages to compensate for the permanent damage to his left shoulder.

Regan’s attorney, Michael Lade, did not immediately return calls and officials at Wal-Mart and Coke could not immediately be reached for comment.
