Convict ordered to pay in wrongful death suit

APPLETON, Wis. (AP) — An Outagamie County judge ordered a convicted murderer to pay his stepson $850,000 for the wrongful death of his mother.

Scott Schmidt, of Appleton, was sentenced more than a year ago for gunning down his estranged wife, Kelly Wing-Schmidt, in their driveway in 2009.

His wife’s son, Noah Wing, sued Schmidt and a judge awarded civil damages Wednesday.

Wing tells WLUK-TV the suit isn’t only about finances. Wing says he wanted to make sure Schmidt can never write a book or profit from his mother’s death.

Scott Schmidt represented himself in the civil suit and claims he has no assets. Schmidt told the court he drained his retirement and bank accounts over legal bills.

Schmidt will be eligible for parole in 2050 when he is 79 years old.
