WAUKESHA, Wis. (AP) — A Waukesha County judge has rejected a bid to reduce a man’s 30-year prison sentence for driving under the influence of prescription drugs in 2008 and killing a pregnant woman and her daughter.
Mark M. Benson argued that Judge J. Mac Davis relied on inaccurate information when in 2009 he sentenced Benson for the deaths.
The Milwaukee Journal Sentinel reports Benson claimed the judge based the sentence on an incorrect report from an expert that said Benson was impaired because he had consumed a large dose of the sleep aid Ambien.
However, Judge Davis denied the motion Wednesday, saying he considered other aggravating factors, including that Benson didn’t apply the brakes on his vehicle before it crashed into the back of the woman’s car in Oconomowoc.
