APPLETON, Wis. (AP) — A Wisconsin judge has ruled in favor of a man who is suing his stepfather over his mother’s shooting death.
Outagamie Judge Dee Dyer found Thursday that convicted murderer Scott Schmidt is liable for the wrongful death of his wife, Kelly Wing Schmidt.
Wing Schmidt’s oldest son, Noah Wing, filed his lawsuit less than a week after his stepfather was sentenced to life in prison.
The 40-year-old Schmidt was convicted of first-degree intentional homicide for fatally shooting his wife in April 2009 outside the Grand Chute home they once shared.
Wing is asking for unspecified punitive damages. The Post-Crescent reports a hearing to determine his award will be held July 6.
In a court brief, Schmidt maintained that he didn’t mean to kill his wife.
